Terms and Conditions for the Mobile Application
“EkoApp Moldova”

 

  • § 1 – Subject of the Terms and Conditions
  1. These Terms and Conditions define the rules for using the mobile application “EkoApp Moldova,” aimed at enhancing biodiversity protection in Moldova by raising public awareness about ecosystems and their provided services. This goal has been achieved through the development and introduction of a mobile eco-application offering a novel way of learning.
  2. Acceptance of these Terms and Conditions means that the User agrees to comply with all its provisions.

 

  • § 2 – Definitions
  1. The terms used in these Terms and Conditions shall mean:
  • Terms and Conditions – this document.
  • Application – the “EkoApp Moldova” mobile application, dedicated to specific operating systems, a free IT system for Users, offering functionalities within the scope of services provided by the Service Provider.
  • Service Availability – visibility of the service at the first router outside the Service Provider’s network.
  • User Profile – a mechanism along with a memory area, providing a space in the Service Provider’s IT system resources. This mechanism enables the User to input, store, or modify data voluntarily and independently in the Application to use its functionalities properly.
  • Force Majeure – an external event that is unforeseeable and unavoidable despite due diligence. Force Majeure includes, in particular, natural disasters, legislative and executive acts, strikes, riots, and acts of war within the territory of the Republic of Poland.
  • Website – (webpage) a document created in one of the SGML languages (HTML, XML, PHP), downloaded from a web server and interpreted on the User’s side via a browser (one web address).
  • Services – IT services as defined by the Act of July 18, 2002, on the Provision of Electronic Services (Journal of Laws No. 144, item 1204, as amended), consisting of providing the Application’s functionalities to the User by the Service Provider.
  • Service Provider – the non-governmental organization “HumanDoc Foundation” based in Opole, Baczyńskiego Street 15, 45-523 Opole, REGON: 142295548, NIP: 527-262-21-03.
  • User – any natural person using the Application.
  • Other Entities – legal entities offering the use of the Application.

 

  • § 3 – Using the Application
  1. The Application is available for download and installation on a mobile device free of charge.
  2. The Application is available for specific versions of operating systems in the respective online stores (Google Play, iOS App Store).
  3. The User can download and install the Application on their mobile device operating on iOS or Android systems.
  4. Using the Application requires the User to create a User account via the Registration form available upon launching the Application.
  5. After registration, the Application automatically provides access to its content—text and audiovisual materials.
  6. All content in the Application is available to the User free of charge throughout the use of the Application.
  7. As part of using the Application, the User may receive interactive notifications related to the content in the Application, generated based on data from the mobile phone (GPS data) on which the Application is installed. To receive interactive notifications, the User must consent to receive them and share their location.
  • § 4 – User Obligations
  1. All Users are required to comply with the Terms and Conditions, general laws, and use the Application in a lawful and ethical manner, particularly respecting the personal rights and intellectual property rights of third parties.
  2. The Service Provider has the right to suspend or terminate access to the Application if the User violates the Terms and Conditions, poses a security risk, transmits inappropriate content unrelated to the Application’s purpose, or engages in activities damaging the Service Provider’s reputation or the Application.
  3. If the User loses the phone number registered with the Application, they must immediately deregister the lost number.
  4. If the User loses access to the email address registered with the Application, they must immediately deregister this email address.
  • § 5 – Service Provider Liability
  1. The Service Provider is not responsible for irregularities or delays in the Application’s operation, especially those beyond its control, including Internet or telecommunication failures.
  2. The Service Provider is not liable for damages resulting from improper operation of the User’s hardware or software.
  3. The Service Provider is not liable for damages resulting from the User’s failure to comply with the Terms and Conditions, including improper use of the Application.
  4. The Service Provider is not liable for damages caused by Force Majeure, data transfer failures, or Internet threats such as hacking or viruses.
  5. The Service Provider reserves the right to block accounts violating the law or these Terms and Conditions.
  6. The Service Provider reserves the right to temporarily disable the Application for updates, modernization, or maintenance and terminate the Services at any time.
  7. The Service Provider reserves the right to update the software and impose system version restrictions for the Application.
  • § 6 – Intellectual Property Protection
  1. The Application is a work under the Act of February 4, 1994, on Copyright and Related Rights (Journal of Laws No. 24, item 83, as amended) and is protected by law.
  2. This protection also applies to other works, trademarks, and elements such as texts, photos, or multimedia in the Application.
  3. Using the Application does not grant intellectual property rights to the works shared within it, except as stated in these Terms and Conditions.
  4. Copying or modifying any part of the Application, including source code, is prohibited.
  5. Users may use the Application’s resources solely for personal purposes.
  6. The Service Provider grants Users a non-transferable, non-exclusive, territorially limited (to Poland) license to use the content within the Application.
  7. The license is valid for the duration of the Services provided by the Service Provider.
  8. If the User violates these Terms and Conditions, the Service Provider may block their access, and the license will expire.

 

  • § 7 – Technical Requirements
  1. The Application requires a mobile device operating on iOS or Android.
  2. Users are responsible for ensuring the necessary device and software.

 

  • § 8 – Complaints Procedure
  1. Complaints about the Services may be submitted in writing to the Service Provider’s address or via email: humandoc@humandoc.pl.
  2. Complaints should include a detailed description of the issue, the occurrence date, the User’s name, and email address.
  3. Complaints will be processed within 30 days of receipt, provided no additional information is required.
  4. Responses will be sent to the email or postal address provided in the complaint.

 

  • § 9 – Final Provisions
  1. Comments and questions regarding the Application should be sent to humandoc@humandoc.pl.
  2. Violations of these Terms and Conditions should be reported to humandoc@humandoc.pl.
  3. Issues not addressed in these Terms and Conditions will be governed by applicable Polish law.
  4. The Terms and Conditions are available in the Application and at www.humandoc.pl.
  5. The Service Provider reserves the right to amend these Terms and Conditions at any time.
  6. The Terms and Conditions come into force on December 20, 2024.
